Terms & Conditions

WHEREAS the CATERER is a duly and registered licensed catering company and agrees to provide catering service for CLIENT’s stated event/function.

 

NOW THEREFORE both parties bind themselves and agree as follow:

 

1.DEPOSIT

In order to reserve and guarantee the date for the event/function, CLIENT must accept the catering contract terms and submit a fifty percent (50%) deposit to the CATERER at time of booking. If deposit is not paid within 24 hours, then CATERER reserve the right to cancel the booking. Such deposit will confirm and guarantee the event date and will be deducted from the total final payment.

 

2. FINAL PAYMENT

CLIENT agrees to pay CATERER the final payment on the day of the event/function. All payments can be paid online via credit card or free bank transfer, unless other prior arrangements have been made. Final payment not received upon delivery will be subject to a late fee of fifty dollars ($50) per day in addition to the final balance.

 

3. GUEST COUNT

Final guest count, not subject to reduction, is to be confirmed at least 48 hours prior to the event/function date. CLIENT will only be charged for the guaranteed number of guests served. A seven (7) days notice MUST be given for any additional guests. If there are more guests attending than the agreed upon guest count, extra charges will be imposed by the CATERER accordingly.

 

4. FOOD QUANTITY

CATERER will prepare between 5-10% overage based upon the final guest count provided by the CLIENT, which the CLIENT will not be charged for. Any additional servings requested by the CLIENT beyond the 5-10% overage will be subject to additional costs. The CATERER, at the request of the CLIENT, will package up any leftovers that are not able to be reused by the CATERER

 

5. ON-SITE CATERING

CATERER will arrive at least 30 minutes prior to event/function time to set-up. Any delay by CATERER due to unforeseen circumstances will be communicated with CLIENT. The CATERER cutoff time will be 30 minutes prior to event/function end time. At which point CATERER will stop food service, package leftovers for CLIENT, and begin the breakdown and removal process before CATERER leaves the event/function.

 

6. DROP-OFF SERVICE

CATERER will suggest serving quantity based on guest count (please see section 3 and 4). CLIENT may add or decrease the serving quantity to better accommodate specific needs no more than 48 hours prior to event/function date.

 

7. TIME

CLIENT will be billed seventy-five dollars ($75) per hour for additional staff hours for any time extension beyond the prior agreed upon time.

 

8. CHANGE OF EVENT (DATE/TIME/VENUE)

Any changes in time, date or venue must be communicated in writing (via email) by CLIENT no more than five (5) days prior to the event/function date. The CATERER will apply all deposits and/or prepayments towards another date, time or venue subject to the availability of the CATERER.

 

9. CANCELLATION

If the event/function is canceled by CLIENT within ten (10) days prior to the event/function date, all deposits and/or prepayments shall be forfeited by CLIENT. If the event/function is canceled by CATERER due to unforeseen circumstances, such as weather, including but not limited, earthquake or fire, CLIENT’s deposit and/or prepayments shall be fully refunded to CLIENT.

 

10. DAMAGE

10.1. CATERER assumes no responsibility for ANY damage or loss of merchandise, alcohol, equipment, furniture, clothing or other valuables prior to, during or after the event. CATERER will do everything possible to ensure that all of CLIENT’s supplies, rentals and equipment are cared for and maintained in good working order and without damage.

 

10.2. When providing the location for the event/function, the CLIENT understands that accidents, breakage and/or damage may sometimes occur. CATERER will not be liable for any damage or loss, unless specifically caused by the willful negligent actions or conduct of CATERER or its employees.

 

11. CATERER LIABILITY

CLIENT absolved CATERER from any third-party claims, except for actions caused by CATERER and/or negligence of its employees. Such claims to amount to a maximum amount of Two Hundred ($200 USD) only.

 

12. INSURANCE

CATERER maintains general liability and automobile insurance at appropriate limits.

 

13. UNLAWFUL ACTIVITIES

The CLIENT will comply with all the laws of the United States of America and the State of California, all municipal ordinances and all lawful orders of police and fire departments and will not do anything on the event/function premises in violation of any laws, ordinances, rules or orders. If unlawful activities should occur on the premises, and the event is cancelled, there will be no refund of any kind from CATERER to CLIENT.

 

14. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the USA.
